Legal Risk Management is a part of overall Enterprise Risk Management.
This lists the basic, main areas that should be included in the area of Legal Risk Management and hence in an in-house legal department.
1. Corporate Governance in general
2. Structural Risk Management. Does the company have the right corporate structure here and abroad. Off shore. Does it protect against severe liabilities. Is it tax efficient?
3. Regularatory Risk Management / Compliance
4. Contractual Risk Management. You have negotiated the contract. It is filed. Who checks if you have neglected rights or obligations in the future?
5. Litigation Risk Management. Litigation prevention, internal decision processes and policies.
6. Enforcement Management. For example copyright infringements, competitors' violation of fair trade practices and competition laws.
7. Document Risk Management. No good in having good contracts and templates if you or your colleagues cannot find them and find them quickly.
8. Political Risk Management and lobbyism.
9. Knowledge Management. How are employees made aware of ongoing legal developments and internal legal strategy and procedures.
